Non-discrimination rule for insured group health plans delayed

The non-discrimination rules, enacted by Sec. 10101(d) of the Health Care and Education Reconciliation Act, that have applied to self-insured health plans for years, were set to be applied to fully insured health plans effective for plan years beginning on or after Sept. 23, 2010.

On December 22, 2010, the government announced a delay in the enforcement of the non-discrimination rules prohibiting insured group health plans from having eligibility or benefits favoring highly-compensated individuals.  Compliance will not be enforced until further guidance is issued by the Internal Revenue Service.
